Remake of the Ports and Maritime Administration Regulation

Reviewed

Project overview

Transport for NSW reviewed the Ports and Maritime Administration Regulation 2012 (the Regulation), as required under the Subordinate Legislation Act 1989 staged repeal process.

Consultation and analysis during the review confirmed the Regulation should be retained. The Regulation has been remade with some amendments as the Ports and Maritime Administration Regulation 2021 (the 2021 Regulation), effective 1 September 2021.

Public consultation on proposed amendments was conducted from 10 December 2020 to 19 February 2021. During consultation, an additional proposal was identified to introduce the ability for the Minister to require empty container storage facility operational data. Consultation on this proposal was undertaken from 10 to 28 May 2021.

The PAMA Regulation Public Consultation Summary  (PDF, 185.02 KB) provides an overview of stakeholder feedback that informed the review, and the PAMA Regulation User Guide (PDF, 468.36 KB) provides a comparison of the 2012 and 2021 Regulation.

The Port Botany Landside Improvement Strategy Mandatory Standards that are made under the Regulation have also been updated. A summary of amendments and the updated Mandatory Standards can be found here.
