Terms and conditions

  1. Participation in this Transport for NSW Spring Cycle 2025 Road Safety Promotion (Promotion) is deemed acceptance of these Terms and Conditions (Terms). Information and instructions on how to participate form part of these Terms.

Promoter

  1. The Promoter is Transport for NSW (ABN 18 804 239 602) of 231 Elizabeth Street, Sydney, NSW 2000.

Promotion

  1. Period The Promotion starts on 12 October 2025 at 9am AEDT and ends on 12 October 2025 at 7pm AEDT (Promotion Period).

Eligible Participants

  1. The Promotion is only open to individual New South Wales residents aged 12 years and above who are not employees (or their immediate family members) of a Public Transport Agency (Participant or Participants). Public Transport Agency means:
    1. Transport for NSW;
    2. Sydney Trains;
    3. Transport Asset Manager of New South Wales (TAM);
    4. NSW Trains;
    5. Sydney Metro; and
    6. All other “public transport agencies” within the meaning of the Transport Administration Act 1988 (NSW).

Entering the Promotion

  1. During the Promotion Period, the Promoter will operate a pop-up stall at the Spring Cycle, where Participants can enter the Promotion by completing the Road Safety and E-bike quiz (Road Safety Game).
  2. To enter the Promotion (Enter or Entry), Participants must;
    1. use the QR code at the Promoter’s stall to complete the promotion entry form;
    2. and complete the Road Safety Game.
  3. Participants who are below 18 years of age (Underage Participants) must have consent from a parent or legal guardian to Enter. The Underage Participants’ parent or legal guardian must tick the required check box on the promotion entry form to confirm they consent to the Underage Participant Entry. Underage Participants will not be allowed to Enter unless their parent or guardian is present during their completion of the Road Safety Game.

Moderation

  1. Entries are subject to moderation. The Promoter reserves the right to exclude or disqualify Entries that do not comply with these Terms.

Judging

  1. This Promotion is a game of chance. The Promoter will award the Prize listed in clause 12 at random to 1 Participant who submits a valid Entry (Winner or Winners).
  2. The Promoter accepts no responsibility if a Winner does not claim their Prize in accordance with these Terms.

Prize

  1. There is 1 voucher to be won to the value of approximately $100AUD. (Prize).
  2. The Prize value is the estimated or recommended retail price in Australian dollars (inclusive of GST) at the time of printing these terms and the Promoter accepts no responsibility for any variation in value.
  3. The Promoter reserves the right to replace the Prize with another item of similar value if for any reason a Prize is not available.
  4. The Prize or any unused portion of the Prize is not transferable and cannot be redeemed for cash.
  5. The Prize was purchased by the Promoter from 99Bikes and is subject to any conditions 99Bikes imposes upon them.

Prize Draw and Claiming the Prize

  1. The Promoter will conduct a prize draw to choose at random the 1 Winner of the Promotion. The prize draw will take place at 231 Elizabeth Street, Sydney, New South Wales, Australia on 3 November 2025 (Draw).
  2. If the Winner is an Underage Participant, the Promoter may award the Prize to the relevant parent or guardian.
  3. The Promoter will notify the Winner by phone and email within 2 days of the Draw.
  4. The Winner must provide the Promoter, written confirmation of their intention to claim the Prize. Winner is solely responsible for providing accurate and complete contact details on the promotion entry form.

Secondary Prize Draw

  1. If a Winner does not claim their Prize by 7 November 2025, they will forfeit their Prize and the Promoter will conduct a secondary prize draw (Secondary Draw).
  2. If a Secondary Draw is required, the Promoter will conduct it on 12 November 2025 at 231 Elizabeth St, Sydney NSW 2000, and choose a new Winner. The previous winner of an unclaimed Prize is not eligible for the Secondary Draw. This process may be repeated as often as necessary until the Prize has been claimed.

Release and Consents

  1. The Promoter may require the Winner to sign a legal release (in a form determined by the Promoter) that releases the Promoter from liability with respect to the Winner’s use of the Prize. The Prize will be deemed to be unclaimed if the legal release is not provided when required. The Promoter may require anyone under 18 years of age to provide a consent signed by their parent or guardian before claiming or using a Prize.
  2. The Promoter is not liable for any loss, damage or injury which arises directly or indirectly as a result of the usage of the Prize once delivered to the Winner.

Prize Collection

  1. Prior to the delivery of the Prize, the Promoter will confirm the email address and delivery address of each Winner. Once the Winner has claimed their Prize in accordance with clause 21, the Promoter will arrange for the Prize to be delivered to the Winner’s provided delivery address within the State of New South Wales.

General

  1. The Promoter will not replace or substitute a Prize or provide compensation where a Winner is unable to claim or use a Prize for any reason including cancellation or discontinuance or unavailability of the Prize, inclement weather or illness or where a Winner does not receive notification or does not receive the Prize through providing an incorrect or outdated address.
  2. The Promoter may modify, suspend, terminate or cancel the Promotion if for any reason (including interference or a breach of these Terms) it cannot conduct the Promotion as originally anticipated or if the fairness of the Promotion would be compromised.
  3. Except for any liability that cannot be excluded by law, the Promoter (including its staff and agents) excludes all liability (including negligence) for any personal injury, illness or death or any loss or damage (including loss of opportunity) whether direct, indirect or consequential, arising in any way out of the Promotion or any Prize, including without limitation such loss or damage arising out of:
    1. any technical difficulties or equipment malfunction (whether or not under the Promoter’s control) including inaccessibility of any website;
    2. any theft, unauthorised access or third party interference;
    3. any Entry or Prize claim that is late, lost, altered, damaged or misdirected (whether or not after receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter;
    4. the use of a Prize or use of the objects purchased using the Prize; and
    5. the award of a Prize to an ineligible Participant.
  4. Any cost associated with lodging an Entry is the Participant’s responsibility. Any costs incurred in receiving, collecting or using a Prize is the Winner’s responsibility.
  5. The Promoter collects Participants’ personal information to conduct the Promotion and may, for this purpose, disclose such information to relevant third parties (including for the purposes of delivering the Prize to the Winner). Participants must provide their personal information otherwise their Entry will be invalid. Participants agree the Promoter may use their personal information to contact them in relation to the Promotion. Personal information will be stored by the Promoter at its registered address and Participants may contact the Promoter to access or correct it.   6. These Terms will be construed according to the laws of New South Wales and entrants submit to the exclusive jurisdiction of the courts of that State. “Including” is not a word of limitation. Failure of the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
  7. The Participants by entering the Promotion, consent to the use of their name, likeness, photograph and statements by the Promoter for promotional purposes.
